Your rights in relation to your personal information held by Victim Support

You have the following rights in relation to your personal information held by Victim Support:

The right to be informed: You have the right to be informed about the processing of your personal information, including regarding what personal information will be held, why that information will be held and what will be done with it, when that information would be shared, how long the information will be held for, and of your rights in relation to your personal information. Victim Support’s main Privacy Notice forms part of our commitment to your right to be informed.

The right of access: You have the right to ask Victim Support to provide you with any information we currently hold on you, subject to reasonable proof of your identity. Victim Support may reserve the right to seek further clarification about the specifics of the information to which you have requested access. Similarly, Victim Support may reserve the right to charge a reasonable fee for, or refuse to respond to, any request it deems manifestly unfounded or excessive. In these instances, we are obliged to let you know of this decision, why it was taken, and of your right to complain to the Information Commissioner’s Office and of your ability to seek to enforce your right through a judicial remedy.

The right to rectification: You have the right to request that Victim Support corrects any personal information the charity holds on you if it is inaccurate or incomplete.

The right to erasure (‘the right to be forgotten’): You have the right to request deletion or removal of your personal information in specific circumstances:

  • The personal information is no longer necessary in relation to the purpose for which it was originally collected/processed
  • Victim Support is relying on consent to process your personal information and you withdraw this consent
  • You object to the processing and there is no overriding legitimate interest to continue the processing
  • The personal information was unlawfully processed
  • The personal information has to be erased in order to comply with a legal obligation
  • The personal information is processed in relation to the offer of information society services (social media) to a child

Victim Support may reserve the right to refuse this erasure however, in specific circumstances.

The right to restrict processing: You have the right to request Victim Support blocks or suppresses processing of your personal information; Victim Support is permitted to store enough personal information to ensure the block is kept in place in the future.

The right to data portability: You have the right to obtain and re-use your personal information for your own purposes across different services. In these instances, Victim Support is obliged to provide you with the relevant personal information in a structured, commonly-used, and machine-readable form.

The right to object: You have the right to object to:

  • Victim Support processing your personal information based on legitimate interests or the performance of a task in the public interest (public task)/exercise of official authority
  • Victim Support processing your personal information for direct marketing purposes
  • Victim Support processing your personal information for scientific/historical research and statistics

Victim Support in turn may reserve the right to continue processing in specific circumstances. However, there is no circumstance under which the processing of personal information for direct marketing purposes can continue if an objection is received.

Victim Support is under a legal obligation to provide you with the opportunity to object to processing at any time. Victim Support’s contact details in relation to processing of personal information are provided towards the top of our main Privacy Notice.

The right of the individual the personal information is about to withdraw consent at any time where the individual’s personal information is being processed based on that consent

As already detailed against the right to erasure on the previous page, you have the right to request deletion or removal of your personal information where Victim Support is relying on consent to process your personal information and you withdraw this consent.

The right of the individual the personal information is about to lodge a complaint with a supervisory authority in relation to the processing of their personal information

You have the right to lodge a complaint with the Information Commissioner’s Office in relation to the processing by Victim Support of your personal information. The Information Commissioner’s Office can be contacted at:
